Less than three years after the enactment of the landmark patent reform law, “The American Invents Act,” Congress is once again considering making significant changes to the U.S. patent code. Last December, “The Innovation Act”, H.R. 3309, passed the House of Representatives by a 325–91 vote. Action has now shifted to the United States Senate which is expected to take up the issue in the upcoming months. Many of the proposed changes relate to patent litigation with a stated purpose of reducing harm caused by so-called “patent trolls.” There is concern voiced by many, however, that some of the proposals adversely affect the interests of many stakeholders in the patent system, including innovators at universities and many life science product manufacturers. The panel of experts will discuss such key issues as heightened pleading requirements, attorneys’ fees awards and recovery, discovery stays, bad faith demand letters, and standards of review for PTO administrative hearings.
This Frameworx session will take place at D’Amore on the 48th floor of the Chase Tower at 111 Monument Circle in Indianapolis.
